Crucially: he was also a longstanding employee of JPMorgan Chase & Co., the biggest bullion bank.The FBIās airport ambush described by Trunz was a crucial step in the pursuit by US prosecutors of JPMorganās precious metals desk, leading up to last weekās climax āĀ the conviction on 13 counts of the man who was once the most powerful figure in the gold market, the deskās former global head Michael Nowak.Michael Nowak departs from federal court in Chicago, Illinois, US, on July 8.Photographer: Cheney Orr/BloombergWatched with a mixture of fascination and horror by precious metals traders around the world, the case has shone a light on how JPMorganās traders āĀ including Nowak and the bankās long-time lead gold trader Gregg Smith āĀ for years allegedly manipulated markets by placing bogus orders designed to wrongfoot other market participants, principally algorithmic traders whose high-speed activity became a major source of frustration.Nowak has become one of the most senior bankers to be convicted in the US since the financial crisis, and faces the prospect of decades in prison, although it could be far less.Nowakās lawyers contend Nowak wasnāt a ācriminal mastermindā and said they will ācontinue to vindicate his rights in court.ā A lawyer for Smith said during closing arguments last month that his clientās orders were legitimate, and there are other explanations to buy and sell futures contracts at the same time on behalf of customers.It took three weeks in court for the government to persuade a jury of Nowak and Smithās guilt. But Smith and Nowak continued working at the bank until 2019, when the US unsealed charges against them.āThe wheels of justice are moving, slowly,ā Gerko tweeted last month.At the Justice Department, the road to JPMorgan began with a decision to begin hunting down traders who made bogus offers to buy and sell commodities that they never intended to execute. The criminal fraud unit hired data consultants to go through billions of lines of trades to spot patterns of market manipulators.As the vast quantities of data was scrutinized, there were certain traders that stood out. Both relatively junior traders pleaded guilty to their own misconduct and agreed to testify against the deskās boss.Nowak was arrested in September 2019, sending a shock wave through the metals world, but the Covid pandemic meant it would be another three years until the trial finally took place.In his testimony, Edmonds, whoād started in an operations role at JPMorgan, described spoofing on the desk as a daily phenomenon and felt obliged to take part because it was part of the normal strategy.The Justice Departmentās move against JPMorganās most senior bullion bankers was celebrated in some corners of the gold and silver markets, where investors and bloggers have long accused the bank of a large-scale scheme to manipulate prices lower. Those allegations prompted multiple investigations by the Commodity Futures Trading Commission, the most recent of which was closed in 2013 after finding no evidence of wrongdoing.The case against Nowak and Smith made no allegations of a systematic plot to suppress prices, instead arguing that they spoofed markets over very short periods of time, and in both directions,Ā to benefit JPMorgan's most important hedge fund clients.And while the convictions are a victory for the prosecutors, the jury rejected the governmentās most sweeping charges āĀ brought under the Racketeer Influenced and Corrupt Organizations Act, or RICO āĀ that the men were part of a conspiracy and that JPMorganās precious metals desk was a criminal enterprise.At JPMorgan, Edmonds said the practice was referred to as āclickingā rather than spoofing, and the traders never discussed it as being illegal despite the firmās own compliance policies making it plain.Ā Trunz even spoke of a running joke involving Smith, who would click his mouse so fast to place and cancel orders that his colleagues would urge him to put ice on his fingers.In 2012, Gerko, who is the founder of quantitative trading firm XTX Markets Ltd., complained to the CME about Smithās trading in gold futures by rapidly entering and canceling orders. The CME began an investigation, which dragged on for three years before concluding heād likely been spoofing.Alex GerkoPhotographer: Rahul Singh/XTX Markets Ltd.āIt took a long time after 2010 to get consistent enforcement,ā Gerko said in a tweet, referring to the Dodd-Frank act in which spoofing was defined and made illegal.After another JPMorgan trader, Michel Simonian, was fired in 2014 for spoofing, Nowak called his traders into his office to ask if they'd been doing the same, according to Edmonds. No one said anything. The incident shocked Edmonds, he said, as Nowak knew it had been going on for years.During the trial, Nowak appeared largely impassive, his face hidden behind a Covid mask. Industry insiders described him in 2020 as introverted and brainy, and testimony during the trial painted him as a well-liked manager, who became friendly with Trunz while the two did a stint working out of JPMorganās London office.During trial, Trunz was asked whether he liked Nowak, the former trader responded: \"I loved him.\"However, the relationship became more complicated after Trunz was approached by authorities. When he contemplated making a deal with the government, Nowak told him not to, according to Trunz, who became audibly choked up as he gave the testimony.Defense lawyers painted Trunz and Edmonds as unreliable āĀ proven liars who were testifying against their clients in order to avoid lengthy prison sentences.Nowak and Smith wonāt be sentenced until next year. For comparison, two Deutsche Bank AG traders convicted of spoofing in 2020 were each sentenced to about a year in prison.Last weekās conviction represents the pinnacle of the US Justice Departmentās crackdown on the illegal trading practice known as spoofing.Ā So far, prosecutors have managed to convict ten traders at five different banks.JPMorgan has already paid $920 million to settle spoofing allegations against it.āEven though the jury rejected the conspiracy and RICO charges, they will consider this a win,ā said Matthew Mazur, an attorney at Dechert LLP who defended one of the Deutsche Bank traders. āThis is probably the end of the precious metals sweep that was done, but I do think there will continue to be cases.āEven after the crackdown, some market participants say spoofing still takes place. Back when commodity futures traded in the pits, brokers had to trade face-to-face. There were 430 decliners and 171 gainers.</p><p>Among the actives, Ascendas REIT shed 1.85 percent, while CapitaLand Integrated Commercial Trust surrendered 3.06 percent, CapitaLand Investment plummeted 3.98 percent, City Developments stumbled 2.55 percent, Comfort DelGro slumped 2.21 percent, DBS Group slipped 1.39 percent, Emperador advanced 1.01 percent, Genting Singapore dropped 1.90 percent, Hongkong Land tumbled 3.42 percent, Keppel Corp declined 3.01 percent, Mapletree Pan Asia Commercial Trust retreated 2.84 percent, Mapletree Industrial Trust weakened 2.05 percent, Mapletree Logistics Trust sank 1.89 percent, Oversea-Chinese Banking Corporation dipped 1.35 percent, SembCorp Industries lost 1.62 percent, Singapore Technologies Engineering skidded 1.94 percent, SingTel eased 0.38 percent, Thai Beverage slid 0.80 percent, United Overseas Bank fell 1.54 percent, Wilmar International was down 0.77 percent, Yangzijiang Financial plunged 3.90 percent, Yangzijiang Shipbuilding tanked 3.70 percent and SATS was unchanged.</p><p>The lead from Wall Street is broadly positive as the major averages opened mixed on Wednesday but accelerated shortly thereafter to finish solidly in the green.</p><p>The Dow surged 548.75 points or 1.88 percent to finish at 29,683.74, while the NASDAQ soared 222.13 points or 2.05 percent to end at 11,051.64 and the S&P 500 jumped 71.75 points or 1.97 percent to close at 3,719.04.</p><p>The rally on Wall Street reflected a positive reaction to the Bank of England's plans to begin temporarily purchasing long-dated U.K. government bonds to address dysfunction in the gilt market. In addition, the BoE postponed the selling of bonds held under the quantitative easing program to October 31.</p><p>Long-term U.K. bond yields have pulled back following the news, while U.S. treasury yields also moved sharply lower after surging in recent sessions. The yield on the benchmark 10-year note showed a steep drop after briefly topping 4.0 percent for the first time in over 12 years.</p><p>Stocks also benefited from a significant pullback by the U.S. dollar, with the U.S. dollar index tumbling by 1.2 percent. The greenback had recently reached new 20-year highs.</p><p>Crude oil prices rose sharply Wednesday after data showed a dip in U.S. crude inventories last week, and the dollar's sharp drop also contributed to the jump in oil prices. West Texas Intermediate Crude oil futures for November ended higher by $3.65 or 4.7 percent at $82.15 a barrel.</p><p>Closer to home, Singapore will release August figures for import, export and producer prices later today. The S&P 500 is up about 9% from its intraday low for the year, hit in mid June. Itās not just the gain that has been convincing. The index, at just over 3970, has crossed a key level, its 50-day moving average of 3919. That means the index is back at a level consistent with a longer-term trendāa higher trend. It means market participants are more comfortable buying stocks at more elevated prices.</p><p>That vote of confidence in the market comes as investors are eyeing a few potential positive developments. One is that inflation may have peaked, especially asĀ commodity prices have declinedĀ in recent months. That means theĀ Fed could soon slow down the pace of interest rate hikes. āYouāve seen a relief rally,ā said Tom Essaye, founder of Sevens Report Research. āThe Fed maybe being slightly less hawkish than you think [is the hope].ā</p><p>That all may sound rosy, and the market still isnāt on the strongest footing. All it would take to send the S&P 500 below its 50-day moving average would be a few days of selling. The next level to watch would be just above 3700. Thatās where buyers have promptly stepped in several times in the past few years to send the index higher. If the index falls below that level, it could mean even steeper losses as confidence in the market outlook wanes. āOne should still tread carefully until more evidence of a floor emerges,ā wrote John Kolovos, chief technical strategist at Macro Risk Advisors.</p><p>Now, the market needs to show even more signs of strength before anyone can believe it has already hit bottom. There is more work to be done before anyone can do a victory lap.For starters, it has been a brutal selloff this year. The S&P 500 is down 17% from its all-time high, hit in early January. The decline has been driven by the Federal Reserveāattempting to fightĀ rapid inflationāreducing liquidity to fixed-income markets to lift interest rates across the board. Higher rates produce lower economic demand and they also make future profits less valuable, causing equity valuations to plummet.Recently, though, the market has enjoyed a convincing rally that could signify it has seen its lowest level of the year. The S&P 500 is up about 9% from its intraday low for the year, hit in mid June. Itās not just the gain that has been convincing. The index, at just over 3970, has crossed a key level, its 50-day moving average of 3919. That means the index is back at a level consistent with a longer-term trendāa higher trend. It means market participants are more comfortable buying stocks at more elevated prices.That vote of confidence in the market comes as investors are eyeing a few potential positive developments. One is that inflation may have peaked, especially asĀ commodity prices have declinedĀ in recent months. That means theĀ Fed could soon slow down the pace of interest rate hikes. āYouāve seen a relief rally,ā said Tom Essaye, founder of Sevens Report Research. āThe Fed maybe being slightly less hawkish than you think [is the hope].āThat all may sound rosy, and the market still isnāt on the strongest footing. All it would take to send the S&P 500 below its 50-day moving average would be a few days of selling. The next level to watch would be just above 3700. Thatās where buyers have promptly stepped in several times in the past few years to send the index higher. If the index falls below that level, it could mean even steeper losses as confidence in the market outlook wanes. āOne should still tread carefully until more evidence of a floor emerges,ā wrote John Kolovos, chief technical strategist at Macro Risk Advisors.Now, the market needs to show even more signs of strength before anyone can believe it has already hit bottom. The next level the S&P 500 needs to rise to is roughly 4100. There, sellers came in to knock the index lower a few times in late May and early June. If it surpasses that level, it indicates people are even more comfortable buying stocksāand Kolovos says the index could see more gains from there.The stock market is at a bit of a fork in the road.
